KNOW YOUR RIGHTS (KYR SIKH CARD)

As a resident in the United States, it’s important to know that you have rights protected under the U.S. Constitution, regardless of your immigration status. Understanding these rights can help you navigate situations with law enforcement or other authorities.

  • RIGHT TO REMAIN SILENT: Under the Fifth Amendment, you have the right not to speak to law enforcement or immigration agents if they try to question you. You can say, “I exercise my Fifth Amendment rights and choose not to answer any questions.”
  • RIGHT AGAINST UNREASONABLE SEARCHES AND ENTRIES: The Fourth Amendment protects you from unreasonable searches and seizures. If law enforcement or immigration agents come to your home:
    • You do not have to let them in unless they have a warrant signed by a judge with your name on it.
    • If they say they have a warrant, ask them to slide it under the door so you can inspect it.
    • You can say, “I do not consent to your entry or to any search of my belongings based on my Fourth Amendment rights under the United States Constitution.”
  • EXERCISE YOUR RIGHTS: In any interaction with law enforcement or immigration agents, you can state, “I choose to exercise my constitutional rights.”
